It's sad that almost every week someone on the Internet uses the Witch Made trademark and then claims, "Oh, get a life! I'm a witch. I made it. It's witch made! And you can't make me stop using it." The irony of such a tirade is that Witch Made
TM was created by a Witch/Shaman/Certified Tarot Reader/a dozen other things. Any of those people could have trademarked WitchMade if they cared, but they didn't. They could have dedicated twenty years of their life to the project, but they didn't. Now they are attacking a venerated crone over their lack of foresight. And that, to be blunt, isn't right and doesn't rise to the standards of The Rule of Three or the Wiccan Creed. They want to take that which the Lady provided for her heirs from them and that isn't right, either. The Gods and Goddesses will be miffed. The Lady has never walked on anyone else's business name, trademark or service mark but other Witches - WITCHES! - are doing it to her and hers. I am saddened by this beyond tears. It just isn't right to be so mean-spirited and call yourself a true Witch. That's the kind of attitude that led to fear and repulsion from the masses and created the environment wherein the Burning Times could happen.
So, here we are and the people who want to use the Witch Made mark as their own are saying, "Prove it. Prove it's yours and not mine." Okay, here's a short course in Trademark Law. You can read it all yourself if you have the time, although it may be difficult to understand every nuance unless you are trained in reading and understanding legal jargon and know the differences between statute and common law. USPTO Keep in mind, though, that case law (also called common law) can and does rear it's powerful head when a court decides a case so don't think reading the statute is all you need to know. It's also important not to read a little of what's on this incredible website and think that covers it. Like the old saying goes, a little bit of knowledge is a dangerous thing.
